Terms of Service

TripleTick is a WhatsApp sales and marketing automation platform that enables businesses to manage WhatsApp conversations, send marketing campaigns, automate messaging flows, and manage customer relationships through the WhatsApp Business API provided by Meta Platforms.

Our platform integrates with Meta's services, including Facebook Login for authentication and the WhatsApp Business API for messaging. Your use of these integrations is also subject to Meta's Platform Terms and WhatsApp Business Terms.

To use TripleTick, you must:

• Be at least 18 years of age
• Have the authority to bind your organization to these Terms
• Have a valid WhatsApp Business Account or be eligible to create one
• Comply with all applicable local, national, and international laws

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information during registration and to update it as necessary. You are responsible for all activity that occurs under your account.

If you use Facebook Login to create your account, you authorize us to access the information permitted by the Facebook permissions you grant.

You agree to use TripleTick only for lawful purposes and in compliance with these Terms. You must not:

• Send spam, unsolicited messages, or bulk messages to contacts who have not opted in
• Send messages that violate WhatsApp's Business Policy or Commerce Policy
• Use the platform to harass, threaten, or abuse any person
• Send messages containing illegal, harmful, or offensive content
• Attempt to circumvent WhatsApp's messaging limits or policies
• Use the platform to collect or harvest personal data without proper consent
• Reverse engineer, decompile, or disassemble any part of the platform
• Share your account credentials with unauthorized individuals
• Use the platform in any way that could damage, disable, or impair our services

When using TripleTick to send WhatsApp messages, you agree to:

• Obtain Opt-In Consent: Only message contacts who have explicitly opted in to receive communications from your business. You must maintain records of consent.
• Respect the 24-Hour Window: Session messages (free-form replies) can only be sent within 24 hours of the contact's last message. Outside this window, you may only send pre-approved message templates.
• Honor Opt-Outs Immediately: When a contact requests to stop receiving messages, you must cease messaging them immediately. TripleTick will automatically mark contacts as opted out when they request it.
• Use Approved Templates: All messages sent outside the 24-hour window must use Meta-approved message templates.
• Comply with Meta Policies: You are responsible for ensuring all messages comply with Meta's WhatsApp Business Platform policies.

Violation of WhatsApp messaging rules may result in suspension of your WhatsApp Business Account by Meta and/or termination of your TripleTick account.

TripleTick offers paid subscription plans. By subscribing, you agree to:

• Pay all fees associated with your selected plan
• Provide accurate billing information
• Accept that fees are billed in advance on a recurring basis (monthly or annually)
• Understand that WhatsApp conversation charges from Meta are separate from TripleTick subscription fees and are billed based on usage

All payments are processed securely through Stripe. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

The TripleTick platform, including its design, features, code, and branding, is owned by TripleTick and protected by intellectual property laws. You retain ownership of all content and data you upload or create through the platform.

You grant us a limited license to use, process, and store your content solely to provide our services to you.

Your use of TripleTick is also governed by our Privacy Policy, which describes how we collect, use, and protect your data, including data received through Meta platform integrations.

You can request deletion of your data at any time. See our Data Deletion Policy for details.

To the maximum extent permitted by law, TripleTick shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the platform.

We are not responsible for:

• Messages that fail to deliver due to WhatsApp API outages or Meta platform issues
• Actions taken by Meta on your WhatsApp Business Account (suspension, restrictions)
• Loss of data due to circumstances beyond our reasonable control
• Third-party services or integrations

Our total liability shall not exceed the amount you paid to TripleTick in the 12 months preceding the claim.

TripleTick is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the platform will be uninterrupted, error-free, or secure at all times. We do not guarantee specific delivery rates or read rates for WhatsApp messages.

We may suspend or terminate your access to TripleTick at any time if:

• You violate these Terms or our Acceptable Use policy
• You violate WhatsApp's Business Platform policies
• Your account is flagged by Meta for policy violations
• You fail to pay subscription fees
• Required by law or legal process

You may terminate your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately. We will retain your data for 90 days after termination, after which it will be deleted.

You agree to indemnify and hold harmless TripleTick, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights (including Meta's platform policies).

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of TripleTick after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration.
